Photographer (607/2015)

(1) A photographer shall have the exclusive right to control a photographic picture, be it in an

original form or in an altered form:

  1. by making copies thereof;

  1. by making it available to the public.

(2) The right to a photographic picture shall be in force until 50 years have elapsed from the end of

the year during which the photographic picture was made.

(3) Photographs referred to in this section shall be correspondingly governed by the provisions of

sections 2(2−4), 3(1−2), 7−9, 11, 11a, 12(1−2), 13, 13a, 14(1, 3 and 4), 15, 16, 16a−16e, 17(1), 18,

19(1, 2 and 5), 20, 22 25, 25a(1−2), 25b, 25d, 25f−25i, 25l, 26, 26a, 26b, 27−29, 39, 40, 40c, 41 and

42. If a photographic picture is subject to copyright, copyright may be invoked.

Valokuvaaja

Tässä pykälässä tarkoitettuihin valokuviin sovelletaan, mitä 2 §:n 2—4 momentissa,3 §:n 1 ja 2 momentissa, 7—9, 11 ja 11 a §:ssä,12 §:n 1 ja 2 momentissa, 13 ja 13 a §:ssä,14 §:n 1, 3 ja 4 momentissa, 15, 16 ja 16 a16 e §:ssä, 17 §:n 1 momentissa, 17 a §:ssä, 17b §:n 1—5 momentissa, 17 c, 17 d ja 18 §:ssä,19 §:n 1, 2 ja 5 momentissa, 20, 22 ja 25 §:ssä,25 a §:n 1 ja 2 momentissa sekä 25 b, 25 d, 25f—25 i, 25 l, 26, 26 a, 26 b, 27—29, 39, 40,40 c, 41 ja 42 §:ssä säädetään. Jos valokuva on tekijänoikeuden kohteena, voidaan vedota tekijänoikeuteen.

Photographer

To the photographs referred to in this section, what is applied in section 2 subsections 2-4, section 3 subsections 1 and 2, section 7-9, 11 and 11 a, section 12 subsections 1 and 2, 13 and 13 a §, §14, subsections 1, 3 and 4, §15, 16 and 16 a16 e, §17, §1, §17a, §17b, §1-5, 17c , in sections 17 d and 18, in sections 1, 2 and 5 of section 19, in sections 20, 22 and 25, in sections 1 and 2 of section 25 a and 25 b, 25 d, 25f—25 i, Sections 25 l, 26, 26 a, 26 b, 27—29, 39, 40, 40 c, 41 and 42 provide. If the photograph is subject to copyright, copyright can be invoked.

Mitä 1 momentissa säädetään, ei koske valokuvaa kuvataiteen teoksesta, jonka suoja-aika on päättynyt.

What is stipulated in subsection 1 does not apply to a photograph of a work of fine art whose protection period has expired.

Comments / analysis

  • Object of protection: Photographs which are not a photographic work (lack of originality).

  • Type of protection: Reproduction in original and modified form and making available to the public. Moral rights of attribution and integrity.

  • Duration: 50 since the picture was made.

Unlike the Directive, the implemented law includes photographs only, not visual arts more widely. Also, according to implementation provisions the new rules are applied only to acts, contracts etc made after 3.4.2023. What this means is still unclear.
