French: Le droit luxembourgeois est déjà conforme à l’article 14 de la Directive 2019/790 puisque, d’une part, les œuvres d’art visuel tombent dans le domaine public à l’expiration de leur durée de protection et d’autre part, seules les créations originales sont protégées par les droits d’auteur. Par conséquent, en application du droit luxembourgeois, la reproduction d’une œuvre d’art visuel tombée dans le domaine public ne bénéficie d’une protection qu’à la condition d’être originale, tel que l’exprime l’article 14 de la Directive 2019/790. À l’instar du projet de loi de transposition belge, le présent projet de loi ne reprend pas explicitement l’article 14 de la Directive 2019/790

English: Luxembourg law already complies with Article 14 of Directive 2019/790 since, on the one hand, works of visual art fall into the public domain at the end of their term of protection and, on the other hand, only original creations are protected by copyright. Therefore, under Luxembourg law, the reproduction of a work of visual art that has fallen into the public domain is only protected if it is original, as expressed in Article 14 of Directive 2019/790. Like the Belgian transposition bill, the present bill does not explicitly include Article 14 of Directive 2019/790.
